RENTAL TERMS AGREEMENT
1. The bicycles and/or accessories, from now on "the goods", linked to this rental contract, are property of JM SPORTS S.C. In no case, by the fact of being a client of the rental contract, rights are acquired over the property or modification of the rented goods.
2. The client assumes the responsibility of returning the rented goods in the same conditions in which they were delivered, except wear and tear from normal and responsible use, unprofessional or improper extreme use. In case of damage, modification, loss or theft of the rented goods, the company JM SPORTS S.C. has the right to claim from the customer the current cost of the goods affected in each circumstance. The deposit or surety, in no case represents an insurance or exoneration of any expense generated in the rented goods. Information on costs available in store.
3. The client declares that the users of the goods in this contract are in good physical and health condition to use the goods, assuming their responsibility in case of illness or disability. The rented goods are for recreational, non-professional or extreme sports use.
4. The company JM SPORTS S.C. disclaims any responsibility in the event of an accident due to misuse or failure to respect traffic and safety regulations as the case may be. It is forbidden to take the goods out of Tenerife Island.
5. In case of breakdown or malfunction of the rented goods, the client must contact and inform the company immediately at the telephones mentioned below in order to find a suitable solution. The company is not responsible nor will it reimburse in any case for damages and prejudices that the client may have had. If the client decides to terminate the contract early, the amount paid for the rest of the duration is non-refundable.
6. In case of punctures, the replacement of the first one is guaranteed at the company's expense, subsequent punctures will be paid by the customer, additionally travel expenses to the place of the breakdown may be charged.
7. In case of bookings, if you do not come and/or do not call us at least 12h before the rental day, you lost the payment done in advance for the first day of the rental.
At JM SPORTS S.C. We treat the information you have given to us in order to provide the requested service/product and bill for it. The data is kept as long as there is a commercial relationship or unl the law establishes it. The data is not transferred to third parties unless there is a legal obligation to do so. The client has the right to obtain information on the treatment of the data, rectification or destruction of the same at any time by contacting the company JM SPORTS S.C. Likewise, the client authorizes to offer them products and services related to those contracted, to send him promotions or to retain him as a client by the most appropriate means.

CONDICIONES GENERALES DE ALQUILER
1. Las bicicletas y/o accesorios, de ahora en adelante “los bienes”, vinculadas a este contrato de alquiler, son propiedad de JM SPORTS S.C. En ningún caso, por el hecho de ser cliente del contrato de alquiler, se adquieren derechos sobre la propiedad o modificación de los bienes alquilados.
2. El cliente asume la responsabilidad de devolver las bicicletas y/o accesorios alquilados en las misma condiciones en que se le han entregado, salvo desgaste de uso normal y responsable, no profesional o de uso inadecuado o extremo. En caso de daños, modificación, pérdida o robo de los bienes alquilados, la empresa JM SPORTS S.C. tiene derecho a reclamar al cliente el costo
actual de los bienes afectados en cada circunstacia. El depósito o fianza, en ningún caso representa un seguro o exoneración de cualquier gasto generado en los bienes alquilados. Información sobre costos disponibles en tienda.
3. El cliente manifiesta que los usuarios de los bienes del presente contrato están en buen estado físico y de salud para utilizar los bienes, asumiendo el usuario su responsabilidad en caso de sufrir alguna enfermedad o discapacidad. Los bienes alquilados son de uso recreativo, no profesional ni de deporte extremo.
4. La empresa JM SPORTS S.C. se exime de cualquier responsabilidad en caso de accidente por mal uso, uso temerario o por no respetar las normas de circulación y de seguridad según sea el caso. Queda prohibido sacar los bienes fuera de Tenerife.
5. En caso de avería o mal funcionamiento de los bienes alquilados, el cliente debe contactar e informar a la empresa inmediatamente a los teléfonos abajo mencionados con el fin de encontrar una solución adecuada. La empresa no se hace responsable ni reembolsará en ningún caso por daños y prejuicios que pueda haber tenido el cliente. Si el cliente decide terminar el contrato anticipadamente, la cantidad abonada por el resto de la duración no es reembolsable.
6. En caso de pinchazos, se garantiza el reemplazo del primero a cuenta de la empresa, los pinchazos siguientes serán a cargo del cliente, adicionalmente se pueden cobrar gastos de desplazamiento al lugar de la avería.
7. En caso de reservas, si no se presenta el día/hora de su reserva Y/o no avisa con una antelación minima de 12h, se le cobrará el primer día de alquiler del total abonado de su reserva.
En JM SPORTS S.C. tratamos la información que nos facilita con el fin de prestarle el servicio/producto solicitado y hacer la facturación del mismo. Los datos se conservan mientras exista relación comercial o hasta que la ley lo establezca. Los datos no se ceden a terceros salvo que exista obligación legal de hacerlo. El cliente tiene derecho a obtener información sobre el tratamiento de los datos, rectificación o destrucción de los mismos en cualquier momento poniendose en contacto con la empresa JM SPORTS S.C. Asimismo, el cliente autoriza a ofrecerle productos y servicios relacionados con los contratados, enviarle promociones o fidelizarlo como cliente por el medio más oportuno.
